These Terms of Service ("ToS") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User"), and Ratio-Informatik GmbH ("we," "us," or "Provider"), concerning your access to and use of our website and services. By creating an account or using our services, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.

2. Description of Service

The Provider offers a digital platform that allows users to search publicly available data breach information sourced from a third-party API. The service is intended for personal, non-commercial use to promote awareness of data exposure. Our service provides access to this information but does not create, own, or verify the underlying data.

3. User Registration and Account Security

Use of our core services requires registration. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Conduct and Prohibited Activities

As a user of the site, you agree not to:

• Use the service for any illegal or unauthorized purpose, including but not limited to harassing, threatening, or defrauding individuals.
• Systematically retrieve data or other content from the site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Engage in any automated use of the system, such as using scripts, bots, scrapers, or data mining tools.
• Attempt to bypass any measures of the site designed to prevent or restrict access, including rate limits.
• Resell or otherwise commercially exploit access to our service or the data provided.

5. Service Plans and Subscriptions

5.1. Free Service

We may offer a free tier of service with limited functionality, such as a maximum number of searches per day. We reserve the right to modify the limitations of the free service at any time.

5.2. Paid Subscriptions

Paid subscriptions provide enhanced access, such as unlimited searches, for a specific duration (e.g., weekly, monthly, lifetime). Subscriptions can be activated by purchasing a plan or redeeming a valid subscription key. A subscription is tied to a single user account and is non-transferable.

6. Fees, Payment, and Refunds

Prices for paid subscriptions are listed on our "Purchase" page. All payments are processed through our third-party payment gateway, SellApp. By making a purchase, you agree to their terms and conditions. Due to the digital nature of our service and the immediate access granted upon payment or key activation, all sales are final. We do not offer refunds for purchased subscription time or activated keys.

7. Disclaimer of Warranties and Limitation of Liability

The service is provided on an "as-is" and "as-available" basis. You agree that your use of the site and our services will be at your sole risk.

We do not warrant, endorse, guarantee, or assume responsibility for the accuracy, completeness, or reliability of any information provided through our service, as it is sourced from third parties. We are not liable for any decisions you make or actions you take based on the information presented.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and your use thereof. In no event will we or our directors or employees be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site, even if we have been advised of the possibility of such damages.

8. Term and Termination

These ToS shall remain in full force and effect while you use the site. You may terminate your use at any time by deleting your account. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the site (including blocking certain IP addresses) to any person for any reason, including for breach of any representation, warranty, or covenant contained in these ToS.

9. Governing Law and Final Provisions

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from this contractual relationship is Berlin, Germany, provided you are a merchant. Should any provision of these ToS be held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
